Srinagar: The Jammu and Kashmir High court on Friday directed the You Tube, Facebook and Twitter to remove all materials, posts and publications which tend to disclose the identity and name of the infant victim of the sexual violence in District Bandipora.
Hearing a suo-moto public interest litigation, a division bench of the court comprising Chief Justice Gita Mital and Justice TAshi Rabstan also directed them to ensure that no such material is uploaded on their channels.
“Intermediaries in Sec 2(1) (w) of the Information and Technology Act 2000, the permissibility for this court to fasten liability for violations of Section 23 of J&K POCSO Act against intermediaries and service providers would have to be examined,” the court said and forthwith direct the You Tube, Facebook and Twitter to remove all materials/posts/publications.
Meanwhile, senior additional advocate general B.A. Dar, placed a report from Inspector General of Police, Kashmir in a sealed cover before the court. The sealed cover was opened and the report taken on record. “The Inspector General of Police, Kashmir shall ensure that the investigation in the matter is conducted strictly in accordance with law,” the court said.
