Wanted to open medical facility say owners of Heaven Cinema, serve legal notice to CRPF to vacate in 30 days

Anantnag: The owners of Heevan cinema, in Ashajipora area of south Kashmirs Anantnag District, have served a legal notice to 40 CRPF Batallion to evacuate the property. They claim the property is occupied, illegaly, for more than a decade.
The property comprising of multi roomed concrete building, single storied shopping complex along with land measuring 4 kanals underneath and appurtenant thereto and is commonly known as Heaven Property.
Owners Naseema Akhtar, Yasir Sideeq Kanue, Mir Mohammad Sideeq Kanue, Mushtaq Ahmad Kanue on Tuesday asked the CRPF to vacate the property.

“The owners purchased the land only with a motive and purpose of expansion of business by establishing a modern health care unit. Owners having human resources comprising of half a dozen highly qualified young men and women including four medical graduates who besiding extending modern health care to public at large would be earn their livelihood by operating an advanced health care center,” the notice reads.
According to the notice in possession of the INS that the owners have purchased the property (supra) from the erstwhile owners some ten years back by virtue of registered instruments with all rights and interests incidental thereto excluding license to operate cinema.
“The property preceding such purchase was forcibly occupied by 40th CRPF Battalion from the erstwhile owners and such occupation continues till date,” notice reads.
The owners said that besides holding the premises forcibly CRPF have been also carrying the activities like ‘running a cinema hall grossly in conflict with motive and interests of owners, notice revealed.’
The notice asks forces to vacate the property and handover its vacant physical procession to property owners within 30 days.
“..In case of your failure and default property owners would be forced to launch regular civil suit for your eviction from the property (supra) at by our risk and costs,” it reads.
The notice comes in wake of CRPF opened the cinema hall ‘Heaven’ after 30 years.
Owners claim that they have repeatedly urged the forces to handover the property to them but to no avail.
“That all afore noted actions, inactions, and misactions have caused not only waste and deterioration of the property but subjected my clients to the serious inconvenience, grave affliction and heavy financial losses,” reads the notice.
