Srinagar, April 11: Court of Special Judge-Designate under NIA Act Srinagar on Tuesday framed charges under sections 13,18,38,39 UA(P) Act, 121 and 120-B IPC against all four accused persons in case FIR No.16/2022 of P/S CI-SIA Kashmir, including the Pakistan based militant Ali KashifJan against whom proceedings under section 299 Cr.PC have been initiated by the Court.

The accused persons involved in the case include Umar Mushtaq Khan S/o Mushtaq Ahmad Khan R/o Begum BaghKakaporaPulwama, Murtaza Rashid Dar S/o Ab. Rashid Dar R/oSamboora District Pulwama, Sajjad Ahmad Dar S/o Gh. Nabi Dar R/o DethooHerporaShangus DistrictAnantnag and Ali Kashif Jan @ Jan Ali Kashif S/o Gohar Ali R/o Village DoisrahTehsil/District Sharsadda, Khyber Pakhtunwa, Pakistan of Jaish-e-Mohammad.

The case was registered by SIA Kashmir on 01.09.2022 on credible inputs that handlers of militant organizations in furtherance of a criminal conspiracy have created new modules of OGWs for aiding, abetting, assisting, harbouring and providing logistic support to militants/secessionist organizations, with intention to further militant and unlawful activities in the UT of J&K. These modules were operating in secrecy with adversaries and operated independently. The modules were in constant touch with handlers / members of militant organizations across the border through encrypted internet messaging platforms, besides others software applications.

During investigation the three local accused personswere found having clandestine connections with Pak based militant Ali Kashif Jan @ Ali Kashif of JeM outfit, through social media and other secret messaging apps with the object and motive to promote militant activities, besides procuring and supplying arms/ammunition among the militants for carrying out militant activities and waging war against the union of India. The State Investigation Agency Kashmir, after thorough investigation of the case presented the charge sheet against all the 04 accused persons before the Designate Court of Special Judge on 04.03.2023.

Today on 11.04.2023 after hearing the arguments from Public prosecutor as well as the defence counsel, the Court found charges against all the accused persons well founded and accordingly framed charges against them.
