Court rejects bail to doctor accused of murderous assault on husband

Srinagar: A court in Kathua on Tuesday rejected bail plea by a doctor, accused with seven others, for murderous assault on her husband in Kathua district of Jammu region last month.
A police official said that Chief Judicial Magistrate Kathua A. S. Langeh rejected the bail application of the doctor, observing that no matter howsoever extreme and sour matrimonial disharmony may be, one partner cannot furtively devise plan in cahoots with alleged contract killers to try elimination of other partner.
According to police case on 19 January this year husband Naresh Kumar of Krishna Colony Kathua while he was returning on Scooty from the ultrasound centre of wife along with his domestic help, was assaulted by 6-7 persons who were armed with ‘tokas and lathies’ and they made a murderous assault on him, causing multiple injuries on his head and other parts of body. When he raised hue and cry, some persons came on spot and assailant fled, leaving motor cycle (PB06AC-9496) on spot. Subsequently FIR no. 32 of 2018 for offences under sections 307, 341, 147, 148 of RPC and section 4/25 Arms Act was registered and investigation started. “During investigation, four accused including the doctor were arrested and it revealed that because of strained relation with her husband, Dr. Nisha asked accused Joginder alias Happy who is an employee in her ultrasound centre to do away with her husband.”
Subsequently, the official said, a criminal conspiracy was hatched which was allegedly masterminded by the doctor to eliminate her husband and occurrence took place.
While rejecting the bail application court observed that “evidence gathered and material obtained during investigation reflects that petitioner devised a plot to eliminate her husband in cahoots with seven co-accused one of whom is stated to have acted as her surrogate who has also faced a trial for offence under section 307 of RPC earlier also and four co-accused are still at large.”
“No matter howsoever extreme and sour matrimonial disharmony may be, one partner cannot furtively devise plan in cahoots with alleged contract killers to try elimination of other partner,” the court said, according to police.
“Release on bail of petitioner at this stage will also have the propensity to embolden the likes of accused and a despicably, wrong message would go to general public at large, more particularly when four co-accused are yet to be arrested,” noted the court and rejected the bail application.
