Srinagar: State Human Rights Organization on Wednesday recommended compensation of Rs five lakhs to a daily-wager in Power Development Department whose left arm was amputated following electrocution while repairing a fault due to ‘department’s negligence.’
Disposing of a case, member SHRC Jung Bhadur Singh Jamwal observed that prima-facie, it appears to be gross violation of human rights, as the victim—Muneer Hussain son of Mohammad Shafi of Noona Mandi Poonch has become permanently disabled and will wholly and solely dependent on others for support of his daily livings.
While recommending Rs 5 Lakh to be paid to the Hussain, the commission order government to deduct Rs.55000 from the compensation which he had already received.
The amount recommended can be borne by Power Development Department, the SHRC said. Besides, the Commission also directed that the services of Hussain be regularized if already not done.
“The Chief Secretary Government of J&K is directed to direct the Power Development Department to pay Rs.5.00 lakh to the (victim) and implement the judgement in letter and spirit.”
Notwithstanding the fact, the SHRC directed Chief Engineer Maintenance & R.E. Wing Jammu to initiate the process for payment of the compensation to Hussain for causing disability due to negligence of the concerned officers and officials and to recommend the action against the then Lineman Abdul Rehman and the then erring Officers/officials of the concerned Division/Sub Division of PDD of the area to show cause why this compensation should not be borne by them. Further, the Commission recommended a disciplinary action against all of them for dereliction of their duties
