JKADCSA approaches CAT, seeks equitable promotion structure for Clerical Cadre

Srinagar, Oct 23: JKADCSA approached CAT seeking a unified and equitable promotion structure for the Clerical Cadre (Ministerial Cadre) of the Revenue Department, similar to that provided for other cadres within the department, to ensure parity and justice.

Following genuine concerns raised by members of the clerical cadre of the Revenue Department, JKADCSA (Ministerial Federation) approached the CAT Bench in Srinagar seeking judicial intervention to address systemic inequities, enforce constitutional mandates of equality and fairness, and restore dignity and career progression for the clerical cadre of revenue department.

This action was in response to a resolution from the clerical cadre of the revenue department, received by the Federation, highlighting that cadre review and formation of recruitment rules are at final stage, but instead of providing uniform promotion avenues at par with Revenue cadre & other existing cadres, by creating Senior Assistant, Head Assistant, and Section Officer posts in newly established administrative units & other supervisory offices including DC offices etc. to resolve long-standing stagnation among clerical cadre particularly Junior Assistants category, the department has proposed abolishing the existing promotion structure by re-designating or creating the WBN cadre by separate GIS, Assistant cadre. This cadre is crucial for junior assistants to overcome stagnation to some extent.

Subsequently, JKADCSA approached the authorities through a series of memoranda and deputations.

Upon finding cadre review is being finalised and is at final stage without considering cadre progression and stagnation issues of the clerical staff, the Federation decided to seek legal intervention to get the stagnation issue resolved and accordingly the Hon’ble Central Administrative Tribunal (CAT) has been approached for the instant relief.

The Central Administrative Tribunal (CAT) has issued a significant order in a petition filed by the Ministerial Staff of the Revenue Department, J&K, through JKADCSA where under, the Tribunal has directed the respondents to take immediate steps to consider the demands of the ministerial cadre of the department on account of the cadre review to address stagnation among the categories of clerical cadre and prevent the abolition/re-designation of existing of WBN cadre and instead of restructure it into progressive stages corresponding to Senior Assistant, Head Assistant, Section officer and Administrative officer within the ministerial cadre and creating of Senior Assistant, Head assistant and Section officer posts in newly established administrative units as well as in all supervisory offices particularly in DC offices, to ensure continuity of promotional avenues which the respondents propose to abolish /re-designate as separate cadre, in terms of the proposed draft rules.

All leaders of JKADCSA (Ministerial Federation), including Jeelani Naik, President, Mir Muzaffar, Vice President; Ashish Sharma, Senior Vice President; Mir Bashrat Saleem, Advisor; Nazir Ahmad Sr. Leader; S. Gurmeet Singh, Provincial President; Reyaz Ahmad, Organising Secretary; Asim Habib Publicity secretary; Jagdesh Thakor, Umar Jan, Provincial Vice President, and the district presidents together appealed the Chief Minister of Jammu and Kashmir, Chief Secretary, Principal Secretary of GAD, Secretary of the Finance Department and especially Secretary of the Revenue Department to have sympathetic consideration into the submission made in the OA/memoranda, inconsonance to the CAT directions, for the sake of fairness and justice
