HC Puts JKCA Elections In Abeyance Till Further Orders

Srinagar, Mar 16: Jammu and Kashmir high court on Tuesday ordered that the conduct of the proposed elections of the office bearers of the Jammu and Kashmir Cricket Association (JKCA) shall remain in abeyance.
Reserving its orders on a number of appeals filed by various parities including City Cricket Club, Srinagar and Others, a bench of Justices Ali Mohammad Magrey and Puneet Gupta also directed that till the final decision in the matter, the Committee of Administrators (CoA) so appointed by the court shall only look into the routine day to day affairs of the Jammu and Kashmir Cricket Association (JKCA).
Besides appeals by number of associations, Board of Control for Cricket in India (BCCI) has also sought permission from the court for appointing adhoc committee to hold the affairs, management and administration of JJKCA, contending that the present management has failed to implement the court directions in letter and spirit.
Through its counsel, the BCCI had submitted that the present Administrators of JKCA with CEO as appointed by the court were obliged under law to hold the free and fair elections of JKCA and to amend the constitution of JKCA in conformity with the Justice Lodha Panel within two months.
The BCCI submitted that even after a gap of more than two and half years, neither the constitution has been amended nor elections held till date.
“The Administrator as also the CEO are running the affairs of JKCA in contrast to the basic spirit of direction contained in the division bench judgment of the J&K High Court and the orders of Supreme Court.”
Other the other hand, a senior advocate appearing on behalf of various clubs informed the court that the Administrators and CEO have amended the JKCA rules in contravention of the mandate of law given by the court as also against the Lodha Committee which he said was approved by the Supreme Court.
He said that the Administrators and CEO withdrew the memberships as well as voting rights of the cricketing clubs who were members of JKCA
