2013 Murder Case: Udhampur Court Sentences Victim’s Wife , 3 Others To Lifer

Udhampur, Oct 12: Additional Principal Sessions Judge Udhampur, S.R Gandhi today awarded life imprisonment to wife and three others for murdering her husband.
The Neelu Devi was convicted of killing her husband Sunny Kumar along with Vicky Kumar Son of Munshi Ram, Rano Devi wife of Munshi Ram and Lakshmi Devi daughter of Munshi Ram. The Court also acquitted fifth accused Neeru Devi wife of Vicky Kumar as prosecution failed to prove case against her .
According to facts of the prosecution case, on 29.04.2013 deceased had gone to his in-laws-house at Sui and all the accused persons which include wife of deceased Neelu Devi were present in the house. On reaching, deceased had heated exchange with the accused persons. In the meantime all the accused persons in furtherance of common object tied the hands of the deceased from behind with a rope and killed him with Danda and threw the body in field after wrapping it in tripal.
After the incident, police received information and registered case under section 117 /2013 under section 302/ 120-B/ 201 /34 RPC against the accused and started investigation. The challan was presented in the court of Additional session judge.
After hearing Additional public prosecutor Anil Kumar Magotra for the State, and counsel for the accused and material on record, the Court sentenced wife of deceased along with three others for life imprisonment while acquitted one woman.
The Court ordered that for the commission of offence under Section 302/34 and 120-B of the RPC each of the convict shall suffer imprisonment for life and a fine of Rs.2,000/-. For the commission of offence under Section 201 RPC each of the convict shall undergo rigorous imprisonment for 01 year (One year) and a fine of Rs.1,000/-. All the sentences shall run concurrently. In default of payment of fine, each of the convict shall further undergo imprisonment for one year.
The Court also directed that a copy of this order shall be submitted to the Chairman District Legal Service Authority, Udhampur with the request to consider this case for compensation to the mother of deceased.
