HC Grants Week’s Time To MHA For Views On Draft Bill To Check Violence Against Healthcare Workers

Srinagar: Jammu and Kashmir High Court on Tuesday granted week’s time to Ministry of Home Affairs , GoI, with regard to Personnel and Clinical Establishments (Prohibition of Violence and Damage to Property) Bill.
As hearing of suo-moto PIL started before a division bench of Chief Justice Gita Mita and Rajnesh Oswal, Vishal Sharma, Assistant Solicitor General of India submitted that he has received instructions from the MHA to request for short adjournment to enable him place the information regarding objections of the Ministry to the Healthcare Service Personnel and Clinical Establishments (Prohibition of Violence and Damage to Property) Bill, 2019 which had been proposed by the Ministry of Health and Family Welfare.
“Let the same be placed before us within one week from today,” the court said.
Ms. Monika Kohli, Amicus Curiae said that a report has been field by one Doctor’s Association of Kashmir through Dr. Suhail Naik.
“Let this report be brought on record,” the court said. The court also granted week’s time to Kohli to place on record a report to be filed by the Doctors Association of Kashmir through its Dr. Nisar-ul-Hassan.
“Let the same be filed within one week from today,” the court said.
Monika Kohli also submitted that despite email sent to Indian Medical Association and the Junior Resident Doctors’ Association Jammu, no response has been received and she would attempt to contact them again. “Let the responses from these associations if any be filed within one week,” the court said. Meanwhile Kohli also informed that she has filed a report on comparison of the legislations already enacted by the various States. “We shall examine this on the next date,” the court said and ordered listing of PIL on May 12.
