HC asks trial courts to retain record if appellate courts seek it

Srinagar: The Jammu and Kashmir High Court on Thursday impressed upon all the courts under its jurisdiction to keep record with them if trial court records are summoned by higher courts and send scanned or photocopies only.
“It is impressed upon all the courts under the jurisdiction of the High Court of J&K to implement in letter and spirit the directions passed by the Supreme Court,” Registrar General of the court said.
The apex court had ordered that wherever original record has been summoned by an appellate or revisional court, photocopy or scanned copy of the same may be kept for its reference and original returned to the trial courts forthwith. “If in future the trial court record is summoned, the trial courts may send photocopy/scanned copy of the record and retain the original so that the proceedings are not held up.”
In cases where specifically original record is required by holding that photocopy wail not serve the purpose, the appellate or revisional court may call for the record onty for perusal and the same may be returned while keeping the photocopy/scanned copy of the same.
