Srinagar: The Jammu and Kashmir High Court has quashed orders under Public Safety Act against four detainees and ordered their release from the preventive detention forthwith “if not required in connection with any other cases.”
“It is settled that when the grounds of detention based on which order of detention has been passed has been quashed then same grounds of detention can’t be made base for passing fresh order of detention,” a bench of Justice Mohammad Yaqoob Mir said and quashed detention order under PSA against Abdul Khaliq Regu and ordered authorities to release him forthwith “provided he is not required in connection with any other case.”
Separately a bench of Justice Tashi Rabstan quashed detention order under PSA against Farooq Ahmad Sofi son of Ghulam Mohammad Sofi of Bangdara, Kreeri District Baramulla. Sofi was detained under PSA order (no.24/DMB/PSA/2017) on 8 May this year.
The court also quashed order (no.71/DMB/PSA/2017) dated 17 July this year, whereby District Magistrate, Baramulla had ordered detaining of Ishfaq Ahmad Kumar son of Abdul Majeed Kumar of Kumar Mohalla, Khanpora under PSA preventive detention and had directed his lodgement in Central Jail Kotebhalwal Jammu.
The court also quashed order (no.02/DMB/PSA/2017) dated 3rd April this year, whereby District Magistrate, Baramulla had ordered detention of Abdul Salam Mir son of Wali Mohammad Mir of Wussan Khoiee Baramulla under preventive detention and his lodgement in Central Jail Kotebhalwal Jammu.
