“We are of the considered opinion that the condition imposed by the High Court, directing the appellant to deposit the amount is uncalled for. The same is accordingly set aside,” a bench of Chief Justice Dipak Misra and Justices A.M. Khanwilkar and Dr. D.Y. Chandrachud said while disposing of an appeal filed by Khyber Agro Farms Pvt. Ltd.

The court passed similar orders with regard to the appeals filed by Kanwal Agro Food Industries and AVON Agro Industries.

A division bench of the high court had passed orders on 23 December 2013 and 24 March 2014.
