SHRC asks DC Bandipora can mentally sick person be booked under PSA, lodged in jail

Srinagar: The State Human Rights Commission on Tuesday asked government to explain whether a mentally sick person can be detained under Public Safety Act and can be lodged in jail.
Justice (retd) Bilal Nazki, Chairperson of the Commission, has passed the orders while hearing a case titled Nazir Ahmad Malla son of Late Abdul Rehman of Ganasthan, Sumbal, Sonawari of district Bandipora regarding arrest of his brother Abdul Samad Mafia who is suffering from mental illness and is lodged in Kotebhalwal Jail, Jammu.
While perusing the record, the Chairperson directed the Deputy Commissioner Bandipora to explain whether a mentally sick person can be detained under PSA and even if he can be detained can he be kept in a jail or had to be lodged in a hospital. The commission has sought report within two weeks.
